Terms and Conditions

These Terms and Conditions (“Agreement”) apply to all services and goods provided by Tianarose LLC (“we,” “our,” or “us”) to the client (“you” or “your”), and form the entire agreement between the parties, superseding any other terms or representations unless expressly agreed in writing.

1. Booking & Payment

  • A non-refundable deposit of 50% is required at checkout to secure your booking.

  • The remaining balance is due no later than 7 days before the event date.

  • Same-day or last-minute bookings (within 7 days of the event) require full upfront payment.

  • Accepted payment methods: Credit card, debit card, or PayPal.

  • All payments must be made in U.S. Dollars and are considered complete only upon receipt of cleared funds.

  • We reserve the right to invoice for interim work, especially when the quote exceeds $2,000.

2. Late Payments & Fees

  • Late payments are subject to a $50 per week late fee.

  • Failure to pay at least one hour prior to service will result in cancellation without refund.

  • We reserve the right to charge 3% monthly interest on overdue balances and recover any costs related to payment collection.

3. Cancellations & Rescheduling

  • 14+ days before the event: Deposit retained; no further fees.

  • Less than 14 days before the event: 50% of the total fee is charged.

  • Within 24 hours / No-shows: Full fee is charged.

  • Shoot date cancellations incur:

    • $150 if within 7 days,

    • 50% of daily shoot rate within 48 hours,

    • 100% of daily shoot rate within 24 hours.

  • Rescheduling must be requested at least 7 days in advance and is subject to availability.

4. Delivery & Editing

  • Services will be delivered per the agreed brief established in writing or through concept meetings.

  • One master copy of the final production will be provided. Additional copies incur a separate charge.

  • Delivery timeframe: Edited videos are delivered within 3 weeks of the event unless otherwise stated.

  • Rush delivery may be available at an additional cost.

  • Raw footage is not included unless prearranged.

5. Editing Materials & Revisions

  • Editing begins only after full payment and submission of all required materials (e.g., names, titles, logos, music files) to: info@tianarose.co

  • Revisions:

    • Included: Minor changes within the “Three Hour Rule” (edits under 3 labor hours post-final master).

    • Additional revisions: $50 per change, unless caused by our error.

  • Any changes inconsistent with the original brief will be billed at our daily rate and include:

    • Inaccurate information supplied by you,

    • Failure to obtain third-party permissions,

    • Significant changes or additions to the original brief.

6. Extra Hours

  • Coverage is limited to the agreed timeframe.

  • Additional hours may be requested in advance and are billed at $75 per hour.

7. Expenses

You are responsible for all reasonable expenses incurred during service delivery. Unless pre-agreed or quoted, standard rates are:

  • Mileage: $0.55/mile

  • Overnight Stay: $150/person

  • Daily Subsistence: $40/day

8. Copyright & Usage

  • Copyright of produced content remains with Tianarose LLC until full payment is received.

  • Upon full payment:

    • You receive a license for personal or promotional use.

    • We retain the right to use the content for our own promotional purposes.

    • Use for broadcast, resale, or redistribution requires additional licensing.

    • Logos, themes, music, and design elements remain our intellectual property and are licensed only for the purposes specified in the brief.

9. Storage Policy

  • All footage is captured in high-definition and stored securely:

    • Transferred to our studio and backed up on a high-speed RAID array.

    • A secondary backup is created, and source tapes are kept in secure off-site storage.

  • Footage is retained during production but not guaranteed to be stored indefinitely post-delivery unless agreed otherwise.

10. Client Responsibilities

  • You are responsible for securing location permissions and insurance.

  • Any delays caused by the client or third parties may affect delivery timelines.

  • We are not liable for delays resulting from incomplete or incorrect materials supplied by you.

11. Warranties & Liability

  • We warrant that all services will be delivered with reasonable skill and care.

  • We accept no liability for:

    • Losses due to incorrect or delayed client materials or instructions,

    • Indirect, consequential, or data loss,

    • Events beyond our control (e.g., illness, equipment failure).

  • Our total liability is limited to either:

    • The price paid for services, or

    • The amount recoverable under our relevant insurance policy.

  • You agree to indemnify us against all claims arising from your breach of this agreement.

12. Refunds

  • Due to the nature of digital products, all sales are final. No refunds will be issued once the final product has been delivered.

13. Assignment

We may assign or sub-contract our rights and obligations under this agreement without your further consent.

14. Severability

If any provision of this agreement is found unenforceable, the remaining terms shall remain valid and enforceable.

15. Waiver

Any waiver of a breach does not constitute a waiver of future breaches.

16. Governing Law

This agreement is governed by the laws of the State of Georgia, and any disputes shall be subject to the exclusive jurisdiction of its courts.

By booking our services and completing payment, you confirm that you have read, understood, and agree to these Terms and Conditions.
